One is a criminal case in the courts; the other is an administrative action by the DMV.

Each can result in a license suspension.

The criminal case and DMV administrative action are independent of each other. One action can happen without the other.

Orange County DMV Process

The APS Hearing begins with the Hearing Officer providing documented evidence supporting the DMV’s position on why your license should be suspended. At this point, without an experienced Orange County DUI lawyer at your side, the DMV will likely suspend your license. If you have retained a DUI attorney, they should make fierce objections to these documents and provide evidence as to why you should retain your driver’s license.

Once evidence has been presented and counter arguments have been made, the Hearing Officer will then take time to make a decision. The DMV Hearing Officer’s decision will eventually be mailed to you and your attorney.

The DMV APS Hearing is conducted with a Hearing Officer, who has the burden of proving the following issues:

If driver provided a chemical test:

  • Was the driver lawfully arrested?
  • Did the officer have reasonable cause to believe that the driver was operating a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
  • Was the driver operating a motor vehicle with 0.08% or more, by weight, of alcohol in their blood?

If the driver refused to submit to or failed to complete a chemical test (a refusal) there are four issues:

  • Was the driver lawfully arrested?
  • Did the officer have reasonable cause to believe that the driver was operating a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
  • Was driver advised that refusal to submit to, or failure to complete, a breath or blood test would result in a one year license suspension or two or three year revocation?
  • Did the licensee refuse to submit to, or fail to complete, a chemical test after being requested to by a peace officer?
